In this Privacy Policy we tell you how we process your personal data at noexcuses AB (“NOQX). We’ll call it the “Policy” and all other used definitions can be found the in the terms and conditions.

The Policy applies to your use of NOQX’s service, available on various devices, including personalized user experiences and the necessary infrastructure. This policy also covers our Free Service, Trial Service, paid versions, and other related services like the Sites and support and from now on, this is what refer to with the “Service” This Policy is however not our Terms which is a separate document. The Terms outline the legal contract between us for using the Service. It also describes the rules of NOQX and your user rights.

We may not delete your data if it’s still needed for its original purpose, required for fraud protection, legally obligated to be retained, necessary for legal claims, or related to unresolved account issues.

Information about your use of our Service and other websites and mobile apps may be used by us to tailor ads to be more relevant to you. This is also known as interest based advertising, targeted advertising, or ‘sharing’ for purposes of cross-context behavioral advertising. 3. Situations when your data may be processed, shared or disclosed

There are a few situations we can think of. These are:

  • When we provide you with our Service and communicate with you by using the email address you gave us to subscribe for updates about our Terms and Policies.
  • You should note that using an organization-provided email (like from work) allows the organization to access and control your Account, potentially moving it to their Team Workspace. This changes how you access and use the Services. For full autonomy, register with a personal email.
  • In corporate changes affecting noexcuses AB, like mergers, your personal data might be transferred or shared, always under strict confidentiality.
  • We may also disclose or use aggregated or de-identified data for any type of business-related purpose such as with prospects, partners for business or research purposes.
  • if we receive a request for information, we may disclose all kinds of data, if this is required by mandatory applicable laws, governmental regulations or rules or by any order of court of competent jurisdiction, arbitral tribunal or governmental authority.
  • With your explicit consent, we can share your data with external parties.

4. Third-Party Service Providers

We engage third-party companies or individuals as service providers or business partners to process your Account to support our business. These third parties are our processors and may, for example, provide and help us with computing and storage services. Please see our entire list of processors. From time to time, we may remove or engage new processors and when we do we will ensure via a written contract that the processor may access and use your data only to deliver the services we have retained them to provide and is prohibited from using such data for any other purpose. We will also ensure that processors are bound by written agreements that require them to provide at least the level of data protection required of us.

5. Transfer to other countries

We try to keep as much data as possible within the EU, for example we always use the European alternative when we can choose between two equally good alternatives and we host all our user’s Accounts on servers located on AWS infrastructure in Frankfurt, Germany. 

We may however still use third party service providers located in third countries. If we transfer personal data internationally, we use tools to ensure compliance with applicable laws and adopt suitable protections for each transfer, like encryption, pseudonymization, and policies to counter unjust or illegal government demands.

To give more comfort and details, transfers to countries outside of the EU/EEA are either conducted under the provisions of the European Commission’s Standard Contractual Clauses as of 4 June 2021 or in accordance with a European Commission’s adequacy decision. We do everything we can to ensure that all our sub-processors have implemented appropriate safeguards to protect the personal data they process on our behalf by for example having contractual obligations in place for them to process such data in compliance with applicable data protection laws. But most importantly, we only use processors to the extent necessary to enable us to provide the best services possible, and we never have and will never sell any personal data to third parties.

6. Data Retention

We retain your personal data only for the duration necessary to deliver the Service and for vital business needs, including service performance maintenance, informed decisions on new features, legal compliance, and dispute resolution.

7. Keeping your personal data safe

We prioritize safeguarding your personal data and implementing relevant technical and organizational measures for its security. No system is however entirely invulnerable, so we’ve established multiple defenses against unauthorized access and excessive data retention, including pseudonymization, encryption, and specific access and retention policies. To secure your account further, we recommend using a unique, strong password exclusive to your account and ensuring you log out after using the Service on shared devices.

8. Children

Our Service is not intended for children under 16 years old, and we do not knowingly collect or process any personal data from those below this age limit. If you are under 16, please refrain from using the Service or providing any personal data. Parents of children under 16 who discover their child has supplied personal data to NOQX should contact us; this may lead to the deletion of the child’s account.

9. Changes to this Policy

We may occasionally make changes to this Policy. When we make material changes to this Policy, we’ll provide you with prominent notice as appropriate under the circumstances. For example, we may display a notice within the Service or send you an email.
